1. WHAT INFORMATION DO WE COLLECT?

Personal Information You Disclose to Us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • Email addresses
  • Names
  • Amazon seller ID

Important: Customer Data Collection Policy. GainHelm is designed as a business analytics tool. We do not collect, store, or process any personally identifiable information about your end customers. While we process order data from your Amazon Seller Central account to calculate profitability, this data contains only aggregated order amounts, product information, and transaction details - not customer names, addresses, phone numbers, or other personal customer information.

Sensitive Information. We do not process sensitive information.

Payment Data. All payment processing is handled directly by LemonSqueezy. We do not collect, process, or store any payment card information. You may find LemonSqueezy's privacy notice here: https://www.lemonsqueezy.com/privacy.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information Automatically Collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. We automatically generate server logs when you access or use our Services. These logs include:
    • Access Logs: IP addresses, timestamps, HTTP request methods, URLs accessed, HTTP response codes, user agent strings
    • Error Logs: Application errors, stack traces (for debugging), error timestamps, affected user sessions (anonymized)
    • Performance Logs: API response times, database query performance metrics, system resource usage
    • Security Logs: Failed login attempts, suspicious activity patterns, rate limit violations

    Retention Period: Server logs are automatically deleted after 90 days. Error logs related to specific debugging sessions may be retained longer if needed to resolve technical issues, but are deleted once the issue is resolved or after 6 months, whichever comes first.

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

What We Do NOT Log: We do not log the contents of your orders, product details, or advertising spend amounts in our server logs. Business data is stored only in our secure database, not in log files.

Information Collected from Third Parties

In Short: We collect limited data from advertising platforms and Amazon SP-API to provide our profit analytics service.

Amazon Seller Central Data. When you connect GainHelm and authorize our application, we collect the following data from your Amazon Seller Central account:

  • Seller information: seller ID, email address, currency settings, marketplace details
  • Order data: order ID, order number, total price, subtotal, tax, shipping cost, discounts, Amazon fees, currency, order status, and order date
  • Product data: product ID, ASIN, product title, SKU, and cost of goods sold (COGS)
  • User preferences: timezone, currency preference, email notification settings

Amazon SP-API Permissions. To access this data, GainHelm requests the following permissions from Amazon SP-API:

  • Orders API - Allows us to read your order history to calculate profit metrics
  • Catalog Items API - Allows us to read your product catalog to track cost of goods sold (COGS)
  • Finances API - Allows us to read Amazon fees and settlement data

These are the only Amazon SP-API permissions we request. We do not request access to customer data, payment information, or any other sensitive seller data beyond what is necessary to calculate your profitability.

Advertising Platform Data (OAuth-Authorized). With your explicit authorization via OAuth, we collect aggregated advertising spend data from:

  • Facebook Ads: Connected ad account IDs, account names, daily aggregated ad spend amounts, impressions (number of times ads were shown), and clicks (number of times ads were clicked)
  • Google Ads: Connected ad account IDs, account names, daily aggregated ad spend amounts, impressions (number of times ads were shown), and clicks (number of times ads were clicked)
  • TikTok Ads: Connected ad account IDs, account names, daily aggregated ad spend amounts, impressions (number of times ads were shown), and clicks (number of times ads were clicked)

Important Limitation: We only access aggregated daily metrics (spend, impressions, clicks). We do not access, collect, or store ad creative content, ad targeting criteria, audience data, demographic information, conversion data, or any other advertising platform data beyond these basic performance metrics.

Google API Compliance. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We only use Google Ads data to display your advertising spend in your GainHelm dashboard for profit calculation purposes.

OAuth Tokens. We store encrypted OAuth access tokens and refresh tokens for Facebook Ads, Google Ads, and TikTok Ads platforms. All tokens are encrypted using AES-256-GCM encryption before being stored in our database and are used solely to fetch your advertising spend data.

We Do Not Collect Information from Your Customers

Important Customer Privacy Notice:

GainHelm does not collect, store, or process any personally identifiable information about your end customers. While we process order data from your Amazon Seller Central account (order amounts, product information, Amazon fees), this data contains only business metrics—not customer names, email addresses, phone numbers, shipping addresses, or any other personal customer information.

Our interaction is strictly limited to you, the seller. We respect the privacy and data protection rights of all individuals, including your customers.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We process your information so you can create and log in to your account, as well as keep your account in working order. (Legal Basis: Performance of Contract - GDPR Article 6(1)(b))
  • To deliver and facilitate delivery of services to the user. We process your Amazon order data and advertising spend data to calculate your net profit, gross profit, profit margins, and other profitability metrics.   • To provide you with analytics and reporting. We process your data to generate dashboards, reports, charts, and insights showing your business profitability over time, by product, by date range, and by other dimensions. (Legal Basis: Performance of Contract - GDPR Article 6(1)(b))
  • To synchronize data. We automatically synchronize new orders from Amazon and advertising spend from connected platforms on a daily basis to keep your profit calculations up to date. (Legal Basis: Performance of Contract - GDPR Article 6(1)(b))
  • To respond to user inquiries/offer support to users. We process your information to respond to your inquiries and solve any potential issues you might have with the requested service. (Legal Basis: Legitimate Interests - GDPR Article 6(1)(f) - providing customer support)
  • To send administrative information to you. We process your information to send you details about our products and services, changes to our terms and policies, and other similar information. (Legal Basis: Performance of Contract - GDPR Article 6(1)(b) and Legal Obligation - GDPR Article 6(1)(c))
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services. (Legal Basis: Legitimate Interests - GDPR Article 6(1)(f) - improving our services)

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
    • Analyze how our Services are used so we can improve them to engage and retain users

    • Understand how our users use our products and services so we can improve user experience

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  • For investigations and fraud detection and prevention
  • For business transactions provided certain conditions are met

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We currently use the following third-party service providers:
    • Railway: Cloud hosting infrastructure provider for application deployment and database hosting
    • Amazon: E-commerce platform that provides order and seller data through Amazon SP-API
    • LemonSqueezy: Payment processor for subscription billing
    • Facebook/Meta: Advertising platform that provides aggregated ad spend data via OAuth-authorized API access
    • Google: Advertising platform that provides aggregated ad spend data via OAuth-authorized API access
    • TikTok: Advertising platform that provides aggregated ad spend data via OAuth-authorized API access
  • Important: We do not sell your personal information. We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We use essential cookies and similar tracking technologies to maintain the security and functionality of our Services. We do NOT use advertising cookies, analytics cookies, or third-party tracking technologies.

Cookies and Tracking Technologies We USE:

  • Session Cookies (Essential): We use session cookies to maintain your logged-in state and remember your preferences during your browsing session. These cookies are essential for the Service to function properly and expire when you close your browser.
  • Security Cookies (Essential): We use CSRF (Cross-Site Request Forgery) tokens stored in cookies to protect your account from unauthorized actions.
  • OAuth State Cookies (Essential): When you connect advertising platforms, we temporarily store OAuth state parameters in cookies (with 10-minute expiry) to prevent CSRF attacks during the authorization flow.

Tracking Technologies We DO NOT Use:

  • Third-Party Analytics: We do not use Google Analytics, Mixpanel, Segment, or any other third-party analytics platforms
  • Advertising Pixels: We do not use Facebook Pixel, Google Ads conversion tracking, TikTok Pixel, or any advertising tracking pixels
  • Marketing Automation: We do not use marketing automation tools that track user behavior
  • Social Media Widgets: We do not embed social media widgets that track users
  • Cross-Site Tracking: We do not track users across other websites
  • Fingerprinting: We do not use browser fingerprinting or device fingerprinting techniques
  • Web Beacons/Clear GIFs: We do not use invisible tracking images in emails or web pages

Why We Take This Approach: As a B2B analytics tool, we believe in respecting your privacy. We only use essential cookies required for authentication and security. Your usage data and business metrics stay within GainHelm and are never shared with advertising networks or analytics providers.

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services, including the ability to stay logged in to your account.

6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), in the United States and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Specific retention periods:

  • Account Information: We retain your account information (email, name, Amazon seller ID) for as long as your account is active or as needed to provide you Services.
  • Order and Financial Data: We retain your Amazon order data and advertising spend data for as long as your account is active to provide historical analytics and reporting. This data is deleted when you request account deletion.
  • OAuth Tokens: Encrypted OAuth tokens are retained for as long as you keep the advertising platform connected. When you disconnect a platform, the associated tokens are immediately deleted.
  • Log Data: Server logs containing IP addresses and usage data are retained for 90 days for security and debugging purposes, then automatically deleted.
  • Backup Data: Data in our backup systems is retained for 30 days and then permanently deleted.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

Specific security measures we implement:

  • Encryption in Transit: All data transmitted between your browser and our servers is encrypted using TLS 1.3 (Transport Layer Security) with strong cipher suites.
  • Encryption at Rest: All data stored in our database is encrypted at rest using AES-256 encryption provided by our hosting infrastructure (Railway).
  • OAuth Token Encryption: All OAuth access tokens and refresh tokens are encrypted using AES-256-GCM encryption with authenticated encryption before being stored in our database.
  • CSRF Protection: We implement CSRF (Cross-Site Request Forgery) protection using cryptographically secure tokens to prevent unauthorized actions on your account.
  • Session Security: User sessions are managed with secure, httpOnly cookies that cannot be accessed by client-side JavaScript, reducing the risk of session hijacking.
  • Access Controls: We implement strict access controls and principle of least privilege for our staff and systems. Only authorized personnel have access to production systems, and all access is logged.
  • Infrastructure Security: Our application is hosted on Railway, which provides DDoS protection, automatic security patching, and infrastructure-level security controls.
  • Regular Security Updates: We regularly update our dependencies and apply security patches to address known vulnerabilities.
  • Secure Development Practices: We follow secure coding practices and conduct regular code reviews to identify and fix potential security issues.

Data Breach Notification: In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify you and the relevant supervisory authority without undue delay and, where feasible, within 72 hours of becoming aware of the breach. The notification will include:

  • The nature of the personal data breach including, where possible, the categories and approximate number of data subjects concerned
  • The likely consequences of the breach
  • The measures taken or proposed to be taken to address the breach and mitigate its possible adverse effects
  • Contact details where you can obtain more information

If the breach is unlikely to result in a risk to your rights and freedoms, we are not required to notify you but will document the breach internally for compliance purposes. We will also notify relevant supervisory authorities as required by applicable law (e.g., GDPR Article 33, CCPA, and other relevant privacy regulations).

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Data Protection Officer

As a small business processing limited categories of personal information and not engaged in large-scale processing of special categories of data, we are not currently required to appoint a Data Protection Officer under GDPR Article 37. Cookie Consent

We use only essential cookies that are necessary for the operation of our Services, specifically for authentication and session management. Under GDPR and other privacy laws, essential cookies do not require your explicit consent as they are strictly necessary for the provision of the service you have requested. We do not use any non-essential cookies (such as analytics, advertising, or tracking cookies) that would require your prior consent. You can find more details about the cookies we use in Section 5 "DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?" above.

Automated Decision-Making and Profiling

We do not use automated decision-making or profiling as defined under GDPR Article 22. All profit calculations and analytics performed by our Services are based on mathematical computations of your own business data (orders, costs, ad spend) and do not involve any automated decisions that produce legal effects or similarly significantly affect you. You remain in full control of all business decisions based on the analytics we provide.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

Verification Process:

  • For Right to Know requests: We will verify your identity by matching at least two (2) data points you provide (such as your email address and Amazon seller ID) against information we maintain in our system.
  • For Deletion requests: We will verify your identity by matching at least three (3) data points and may require a confirmation response to an email sent to the address associated with your account.
  • Additional verification: If we cannot verify your identity using the methods above, we may request additional documentation such as government-issued identification or business registration documents.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at [email protected]. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
